On Friday, 6 February, the Supreme Court of India refused to entertain a petition filed by Prashant Kishor’s Jan Suraaj party seeking to annul the 2025 Bihar Assembly Elections.
As per reports, Prashant Kishor’s Jan Suraaj Party had alleged election malpractice through large scale financial inducements given by the incumbent government in the state.

Prashant Kishor’s plea claimed that the Nitish Kumar government violated the Model Code of Conduct by transferring ₹10,000 each to over 1.5 crore women voters under the Mukhyamantri Mahila Rojgar Yojana, amounting to ₹15,600 crore, just before the polls. Jan Suraaj petition described it as blatant vote-buying.
A bench headed by CJI Surya Kant questioned the credibility of the Jan Suraaj party to claim the electoral process as fraudulent, citing that despite contesting in 242 seats, the party failed to win even one seat in the Bihar elections.
“People rejected you, and now you approach the judicial forum?”, the CJI asked, hinting that the petition was a publicity stunt. The SC refused to issue omnibus directions for the entire state at a political party’s instance.
While dismissing the plea, the bench advised approaching the Patna High Court or Election Commission and indicated that the broader issue of electoral “freebies” would be examined in suitable future cases.
